​PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING YOUR ORDER. WE RECOMMEND PRINTING AND RETAINING A COPY FOR FUTURE REFERENCE.
The Rocking Bohemian (“we”, “us”) may update these Terms & Conditions without prior notice. The version of the Terms & Conditions in place at the time of your order will govern the contract.
1. The Contract
These Terms apply to all goods supplied by The Rocking Bohemian. They do not affect your statutory rights as a consumer.

Order Acceptance: Your order is an offer to buy. A contract is only formed when we dispatch your goods. The initial "Order Confirmation" email is an acknowledgement of receipt, not a formal acceptance of the contract.

Termination: We reserve the right to cancel the contract if payment is not received in full or if we suspect fraudulent activity.
2. Description and Price of Goods

Accuracy: We aim to describe items as accurately as possible. However, due to the nature of handmade or natural products (such as soapstone or crystals), slight variations in color, shape, and texture may occur.

Pricing: Prices are in GBP (£) and include VAT at the current UK rate.

Pricing Errors: If an item is underpriced in error, we are not obliged to provide it at that price. We will contact you to offer:

A new order at the correct price.

Cancellation of the full order.

Cancellation of the mispriced item and shipping of the remainder. If we cannot reach you within 14 days, the order will be cancelled.

Availability: If items are out of stock, we will contact you. We do not offer back-orders. If unavailable items total 20% or less of your order value, we may ship the available items and refund the difference to prevent delivery delays.
3. Payment
Payment is due at the time of order via debit or credit card. Goods will not be dispatched until funds have cleared.
4. Delivery

Address: We ship to the address provided at checkout. If you provide an incorrect address or postcode and the parcel is returned to us, we will refund the cost of the goods only. A new order must be placed for redelivery.

Redirection: Once dispatched, redirection is at our discretion and will incur a fee equal to the original shipping charge.

Timeframes: We aim for delivery within 3–5 working days. While we make every effort to meet these times, we are not liable for losses caused by reasonable or unavoidable courier delays (e.g., peak Christmas periods).

Ownership: Risk of loss or damage passes to you once the items are delivered to your address or left in a designated "safe place."
5. Your Right of Cancellation
Under the Consumer Contracts Regulations, you have the right to cancel your contract within 14 days of receiving your goods.

You must return the goods at your own cost within 14 days of your cancellation notice.

Items must be returned unused and in their original packaging.
6. Refund Policy

Timing: We will process your refund within 14 days of receiving the returned goods (or proof of postage).

Method: Refunds will be issued to the original payment method.

Scope: We refund the full item cost. Standard outgoing shipping costs are refunded for full order cancellations, but the cost of returning the items to us is the responsibility of the customer unless the item is faulty.
7. Warranty & Faulty Goods
All products carry a 6-month manufacturer’s warranty against defects (excluding consumables like batteries or tea lights).

Faulty/Damaged on Arrival: You must notify us within 48 hours of receipt for damaged items and within 72 hours for faulty/incomplete items.

Evidence: For items under £15, we typically require photographic evidence of the fault rather than a physical return. For silver jewelry, returns must be sent via 2nd Class Large Letter.

Exclusions: Warranty does not cover fair wear and tear, accidental damage, misuse, or neglect.

Incorrect Items: If we send the wrong item, notify us within 30 days. We will arrange a replacement or refund and cover the return shipping costs.

We recommend using a "Signed For" service for items over £15. We are not responsible for returns lost in transit.
9. Data Protection & Privacy (UK GDPR)
We take your privacy seriously. All personal data is handled in accordance with the Data Protection Act 2018 and UK GDPR.

We only use your data to process orders, manage your account, and (if opted-in) send marketing materials.

10. Product-Specific Terms

Natural Materials: No replacements/refunds for shipping costs will be made for dissatisfaction with natural color variations in products like soapstone or wood, as these are unique by nature.

Cosmetic Goods: All cosmetics are legally certified. We strongly recommend a patch test before full use. We are not liable for allergic reactions if a patch test was not performed.

Safety: The Rocking Bohemian is not liable for injury or damage resulting from the misuse of products (e.g., leaving candles and/or incense unattended).
11. Limitation of Liability
The Rocking Bohemian is not liable for any business loss (loss of profits, revenue, or wasted expenditure) or any indirect loss that was not foreseeable to both parties when the contract was formed.
12. Governing Law
These terms are governed by English Law. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
